Welcome to Throw Ann Arbor.

These Terms & Conditions (“Terms”) govern your use of throwannarbor.com (the “Site”) and your purchase or use of classes, workshops, courses, memberships, events, gift cards, studio access, pottery services, and other products or services offered by Ceramic Planet LLC, doing business as Throw Ann Arbor (“Throw,” “Throw Ann Arbor,” “we,” “us,” or “our”).

By using the Site, creating an account, making a purchase, booking a service, enrolling in a membership, or otherwise agreeing to these Terms, you agree to be bound by them.

If you do not agree to these Terms, do not make a purchase or use services that require acceptance of these Terms.

1. Eligibility and Authority to Purchase

You must be at least 18 years old to enter into a binding purchase or agreement with Throw Ann Arbor unless otherwise permitted by applicable law.

If you purchase a class, workshop, event, camp, membership, or other service for another person, you represent that you are authorized to make that purchase.

Participation by minors may require consent and documentation from a parent or legal guardian, including a separate liability waiver.

A parent or guardian registering a minor represents that they have legal authority to provide the required consent on behalf of that minor.

2. Classes, Workshops, Courses, and Events

Throw Ann Arbor offers pottery-related services that may include wheel throwing, handbuilding, pottery painting, multi-week courses, camps, private events, parties, studio memberships, and other educational or recreational activities.

The exact description, price, duration, eligibility requirements, materials included, firing allowance, pickup expectations, cancellation terms, and other conditions applicable to a particular service will be displayed on the applicable service page or during checkout.

You are responsible for reviewing those details before completing your purchase.

Where a service page, membership agreement, event agreement, registration form, or other written agreement contains terms that are more specific than these Terms, the more specific terms will control with respect to that service.

3. Booking and Payment

Payment may be required in full at the time of booking unless Throw Ann Arbor agrees otherwise in writing.

All prices are stated in U.S. dollars unless otherwise indicated.

You authorize Throw Ann Arbor and its payment service providers to charge the payment method you provide for purchases you authorize, including any applicable taxes, fees, additional pieces, firing fees, membership charges, or other charges clearly disclosed to you.

You represent that you are authorized to use any payment method you submit.

Throw Ann Arbor may cancel or decline an order or booking if payment cannot be processed, the booking resulted from an obvious pricing or technical error, the service is unavailable, or we reasonably suspect unauthorized or fraudulent activity.

4. Workshop and Class Cancellation Policy

Unless a different cancellation policy is clearly disclosed for a particular service at the time of purchase, the following policy applies to eligible workshops and Try Wheel Throwing sessions:

A participant may receive one free reschedule when at least 24 hours' notice is provided before the scheduled session.

A booking may be canceled for a refund when cancellation occurs at least three days before the scheduled class begins.

If a participant misses a scheduled session without providing the required notice, the participant will be charged the full amount of the booking and will not be entitled to a reschedule.

Once a class has been rescheduled, that booking is no longer eligible for a refund unless required by law or otherwise agreed to by Throw Ann Arbor.

Certain courses, camps, private events, parties, special events, memberships, or promotional bookings may have different cancellation or refund policies. Any such policy disclosed on the applicable service page, registration page, invoice, event agreement, or checkout page at the time of purchase will govern that purchase.

5. Changes or Cancellations by Throw Ann Arbor

Throw Ann Arbor may occasionally need to change an instructor, modify a schedule, postpone a session, close part or all of the Studio, or cancel a service because of staffing issues, equipment problems, severe weather, utility interruptions, emergencies, safety concerns, or other circumstances.

When Throw Ann Arbor cancels a paid class or service that cannot reasonably be provided, we may offer an appropriate reschedule, credit, replacement service, or refund depending on the circumstances and the terms applicable to the service.

We will make reasonable efforts to notify affected customers using the contact information provided with their booking.

6. Late Arrivals

Participants are responsible for arriving on time.

Pottery classes frequently involve safety instructions, demonstrations, and sequential instruction that occur at the beginning of a session. A late arrival may make it unsafe or impractical for a participant to join a class already in progress.

Throw Ann Arbor may refuse or limit participation by a significantly late participant when reasonably necessary for safety, instruction, or the experience of other participants.

A late arrival does not automatically entitle the participant to a refund, credit, additional instruction time, or rescheduled session.

7. Liability Waiver and Assumption of Risk

Pottery and ceramic activities involve inherent risks.

Activities may involve pottery wheels, hand tools, sharp tools, heavy objects, wet or slippery surfaces, clay dust, glazes and other ceramic materials, electrical equipment, hot equipment, kilns, shelving, furniture, and other hazards normally associated with a working ceramics studio.

Participation in certain Throw Ann Arbor activities requires execution of a separate Participant Liability Waiver and Assumption of Risk Agreement.

The liability waiver is a separate agreement from these Terms.

A participant who is required to execute a waiver may not participate until the required waiver has been completed.

For participants who are minors, Throw Ann Arbor may require the waiver to be completed by a parent or legal guardian.

Nothing in these Terms is intended to waive any legal right that cannot lawfully be waived.

8. Safety Rules and Staff Instructions

Participants must follow all posted Studio rules and reasonable safety instructions provided by Throw Ann Arbor staff.

You agree not to:

• intentionally misuse Studio equipment;

• operate equipment that you have not been authorized or trained to use;

• enter restricted areas;

• interfere with kilns or other equipment that customers are not permitted to operate;

• engage in conduct that creates an unreasonable safety risk;

• intentionally damage Studio property or another customer's work;

• harass, threaten, or endanger employees, instructors, members, guests, or other customers; or

• participate while impaired to an extent that makes participation unsafe.

Throw Ann Arbor may immediately stop a participant from using equipment or participating in an activity when staff reasonably believe continued participation presents a safety risk.

9. Alcohol and Throw & Sip Events

Certain events may be designated for participants age 21 or older and may include a beverage.

Participants must satisfy any age requirements applicable to the event.

Throw Ann Arbor may request valid government-issued identification when appropriate.

The availability of an alcoholic beverage does not authorize unsafe or disruptive behavior. Throw Ann Arbor may refuse service or participation when reasonably necessary for safety or legal compliance.

Participants are responsible for arranging safe transportation and complying with applicable alcohol laws.

10. Minors and Youth Programs

Throw Ann Arbor offers certain programs for children and teenagers.

Age requirements differ by program and are displayed on the applicable service or registration page.

Parents or guardians are responsible for providing accurate emergency, medical, allergy, authorized-pickup, and other information reasonably requested for youth programs.

Parents and guardians must notify Throw Ann Arbor of information reasonably necessary for the Studio to safely supervise a participant.

Throw Ann Arbor may establish additional rules for camps, youth classes, pickup procedures, behavior, emergency contacts, and supervision. Those rules may be provided during registration or before participation.

11. Ceramic Work and the Firing Process

Ceramics is an inherently unpredictable process.

Drying, bisque firing, glazing, and glaze firing can result in cracking, warping, glaze defects, discoloration, breakage, kiln damage, adhesion to kiln furniture, or complete loss of an item.

Although Throw Ann Arbor takes reasonable care when handling customer work, we cannot guarantee that every ceramic item will successfully survive drying or firing or that the final color, surface, dimensions, or appearance will exactly match a customer's expectations.

Estimated firing and pickup times are estimates rather than guaranteed completion dates.

Where a particular class or service provides a stated remedy for an item damaged or lost during the ceramic process, the remedy stated for that service will apply.

For example, if a service page states that a customer will receive a particular refund, replacement, credit, or makeup session when qualifying work does not survive firing, that policy is incorporated into the customer's purchase.

12. Finished Work and Pickup

Customers are responsible for picking up completed work after receiving notice that it is ready.

Throw Ann Arbor may establish reasonable pickup deadlines for completed work. Any applicable deadline will be posted, communicated to the customer, or included in the applicable service terms.

Because Studio storage space is limited, items that remain unclaimed for an extended period after an applicable pickup deadline may be discarded, recycled, donated, or otherwise removed after reasonable notice where appropriate.

Customers are responsible for ensuring that Throw Ann Arbor has accurate contact information for pickup notifications.

13. Customer-Supplied Clay, Glazes, and Materials

Members or other authorized customers may be permitted to use certain personally supplied ceramic materials.

Throw Ann Arbor may prohibit the use of any clay, glaze, underglaze, chemical, material, or firing process that has not been approved for use in the Studio.

Materials that are incompatible with Studio firing temperatures or processes can damage kilns, shelves, other customers' work, or Studio equipment.

Customers must comply with all Studio procedures concerning outside materials.

A customer may be financially responsible for damage caused by knowingly or negligently using prohibited, mislabeled, contaminated, or incompatible materials.

14. Memberships

Throw Ann Arbor may offer recurring Studio memberships, including different membership tiers with different levels of access and benefits.

Membership features, prices, firing allowances, guest privileges, Studio access, prerequisites, storage allowances, and other benefits are those displayed at the time the customer enrolls.

Memberships may also be governed by a separate Membership Agreement and Studio Rules.

 

Recurring Billing

If you purchase a monthly membership, you authorize Throw Ann Arbor and its payment processor to automatically charge the applicable membership price to your selected payment method each billing period until the membership is canceled.

 

The amount and billing frequency will be clearly presented to you before enrollment.

 

By enrolling, you expressly authorize these recurring charges.

 

Membership Cancellation

Members may cancel recurring membership charges using the cancellation method provided by Throw Ann Arbor, including any online account cancellation functionality made available through our booking platform, or by contacting Throw Ann Arbor when applicable.

 

Cancellation stops future recurring charges after the cancellation becomes effective.

 

Unless otherwise stated in the applicable Membership Agreement, cancellation ordinarily takes effect at the end of the member's then-current paid billing period.

 

Membership payments already earned for a current billing period are not prorated solely because a member elects not to use the Studio during that period, except where required by law or otherwise stated in the Membership Agreement.

 

Throw Ann Arbor will not intentionally require a member to continue recurring payments after a valid cancellation has become effective.

 

Failed Membership Payments

If a recurring membership charge is declined or cannot be processed, Studio access and membership privileges may be temporarily suspended until the account is brought current.

 

Membership Changes

Throw Ann Arbor may change membership prices or benefits prospectively.

Material price changes will not be applied retroactively to a completed billing period. Where required by law or our applicable agreement, reasonable advance notice will be provided before a new price applies to a future billing period.

 

15. Member and Guest Access

Membership Studio access is personal to the member and may not be transferred or shared unless Throw Ann Arbor expressly permits otherwise.

 

Members are responsible for guests they bring into the Studio.

 

Guests may be required to sign a liability waiver before participating in Studio activities.

 

Guest passes and access privileges are subject to the rules associated with the member's membership tier.

 

Where a membership includes after-hours or 24/7 access, the member must comply with all additional security, safety, entry, locking, equipment, guest, and closing procedures established by Throw Ann Arbor.

 

Access codes, keys, credentials, or other security devices may not be shared with unauthorized persons.

Throw Ann Arbor may suspend after-hours access when reasonably necessary for maintenance, safety, emergencies, private events, legal compliance, or other operational needs.

 

16. Suspension or Termination of Studio Privileges

Throw Ann Arbor may suspend or terminate a participant's or member's Studio privileges for material violations of these Terms, applicable Studio rules, a Membership Agreement, safety requirements, or other agreements with Throw Ann Arbor.

 

Immediate suspension may occur when reasonably necessary to protect customers, employees, Studio property, or the safety and operation of the Studio.

 

Examples may include theft, deliberate property damage, harassment, violence or threats, repeated unsafe use of equipment, unauthorized access, sharing access credentials, or serious interference with Studio operations.

 

Any refund resulting from termination will be determined under the applicable agreement and applicable law.

17. Personal Property

Customers are responsible for their personal property while at the Studio.

 

Throw Ann Arbor is not responsible for ordinary loss, theft, or damage to personal items left at the Studio except to the extent liability cannot legally be excluded.

 

Members using storage areas are responsible for properly identifying and storing their materials and belongings in accordance with Studio rules.

 

Throw Ann Arbor may establish procedures for abandoned or unidentified property.

 

18. Gift Cards

Throw Ann Arbor gift cards may be redeemed for eligible products and services according to the terms provided when the card is purchased.

 

Gift card holders are responsible for safeguarding gift card codes.

 

If you lose a gift card code, contact Throw Ann Arbor. We may be able to locate or replace the code after reasonably verifying the purchase or recipient.

 

Gift cards are not redeemable for cash except where required by law.

 

Any expiration, dormancy, fee, redemption, or refund practice applicable to gift cards will comply with applicable law.

 

19. Promotions and Discounts

Promotional offers, discount codes, referral offers, group discounts, and other special pricing may have separate eligibility requirements or expiration dates.

 

Unless otherwise stated, promotional offers:

• cannot be combined with other promotions;

• have no cash value;

• may apply only to specified services; and

• may be modified or discontinued prospectively.

 

Promotions will not be modified retroactively after an eligible transaction has been completed.

 

20. Website Accounts

Certain features of the Site may require an account.

 

You are responsible for maintaining the confidentiality of your password and other account credentials and for activity occurring through your account to the extent caused by your failure to reasonably safeguard those credentials.

 

Please notify Throw Ann Arbor if you believe your account has been accessed without authorization.

 

You may not impersonate another person, create an account using materially false information, or use another person's account without authorization.

 

21. Acceptable Use of the Site

You may use the Site only for lawful purposes.

 

You may not attempt to:

• interfere with operation or security of the Site;

• obtain unauthorized access to accounts or systems;

• introduce malicious software or code;

• scrape or systematically extract Site content in a manner that materially burdens the Site or violates applicable law;

• use the Site to engage in fraud;

• submit knowingly false payment or identity information; or

• use Throw Ann Arbor's content or trademarks in a manner that falsely implies endorsement or affiliation.

 

22. Intellectual Property

Unless otherwise indicated, the Site and its original content—including Throw Ann Arbor's name, logos, graphics, photographs, text, designs, videos, course descriptions, and other materials—are owned by or licensed to Ceramic Planet LLC and are protected by applicable intellectual property laws.

 

You may access and use the Site for your personal, noncommercial use.

 

No ownership rights are transferred to you by your use of the Site.

 

Nothing in these Terms gives Throw Ann Arbor ownership of the original artistic designs you create in your own ceramic work merely because you created the work at our Studio.

 

23. Photography and Media

Throw Ann Arbor may photograph the Studio, events, classes, or finished work from time to time.

 

Where consent is legally required for identifiable promotional use of a participant's image or likeness, Throw Ann Arbor will obtain appropriate permission.

 

A separate photo or media release may be used for certain events or youth programs.

 

These Terms alone are not intended to serve as a blanket parental media release for minors.

 

24. Privacy

Our collection and use of personal information is described in the Throw Ann Arbor Privacy Policy.

 

The Privacy Policy is incorporated into these Terms by reference.

 

Payment information may be processed by third-party payment processors integrated with our website provider. Throw Ann Arbor does not itself need to receive or store a customer's complete payment card number when the transaction is handled directly by the payment provider.

 

25. Electronic Communications

When you make a booking, purchase, membership enrollment, or inquiry, you consent to receive communications reasonably necessary to administer that transaction, such as receipts, appointment confirmations, schedule changes, pickup notices, safety information, membership notices, and customer-service communications.

 

Marketing emails are separate from transactional communications. Where required, marketing messages will be sent according to the preferences or consent associated with your account, and you may unsubscribe from marketing email.

 

Unsubscribing from marketing messages does not prevent us from sending communications necessary to administer an active booking, purchase, membership, or other transaction.

 

26. Third-Party Services and Links

The Site may rely upon or link to services operated by third parties, including website hosting, scheduling, payment processing, maps, analytics, advertising, social media, and communication platforms.

 

Those services may be subject to their own terms and privacy policies.

 

Throw Ann Arbor is not responsible for the independent content or operation of third-party websites or services that we do not control.

 

27. Website Information and Availability

We make reasonable efforts to keep information on the Site accurate and current.

 

However, schedules, instructor assignments, availability, inventory, prices, hours, Studio access, estimated firing times, and other operational information may change.

 

Obvious typographical, technical, or pricing errors do not require Throw Ann Arbor to provide a product or service on materially erroneous terms. If an error affects a completed purchase, we will contact the customer and provide an appropriate opportunity to accept the corrected terms or cancel the affected transaction.

 

We do not guarantee uninterrupted access to the Site.

 

28. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Site is provided on an “as available” basis.

 

Except for warranties or promises expressly made by Throw Ann Arbor or imposed by applicable law, we disclaim implied warranties relating solely to operation of the Site.

 

Pottery instruction is recreational and educational in nature. Individual artistic results and skill development will vary, and participation does not guarantee any particular artistic or technical result.

 

Nothing in this section eliminates warranties or consumer rights that cannot legally be disclaimed.

 

29. Limitation of Liability

To the maximum extent permitted by applicable law, Ceramic Planet LLC and its owners, employees, instructors, agents, and representatives will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of the

Site or a commercial transaction with Throw Ann Arbor.

 

Any limitation relating to physical participation in Studio activities is governed primarily by the applicable Participant Liability Waiver and Assumption of Risk Agreement, rather than this website provision.

 

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability that cannot legally be waived.

 

30. Responsibility for Damage

Customers and members may be held responsible for the reasonable cost of repairing or replacing Studio equipment or property when damage results from intentional misconduct, theft, unauthorized equipment use, or reckless or materially negligent violation of

 

Studio rules.

Normal wear and tear and ordinary accidents associated with proper use of Studio equipment are not treated as intentional property damage.

 

31. Indemnification

To the extent permitted by applicable law, you agree to indemnify Ceramic Planet LLC against third-party claims, losses, or reasonable expenses resulting directly from your intentional unlawful conduct, fraud, or material violation of these Terms.

This provision does not require you to indemnify Throw Ann Arbor for liabilities that applicable law places on Throw Ann Arbor or that cannot lawfully be transferred to you.

 

32. Events Beyond Our Reasonable Control

Throw Ann Arbor will not be responsible for delay or failure to perform caused by circumstances reasonably beyond our control, including severe weather, fire, flood, power or utility failure, government orders, public emergencies, building closures, equipment failures, labor disruptions, or similar events.

 

When such circumstances materially affect a paid service, we will make reasonable efforts to provide an appropriate reschedule, credit, refund, or other resolution consistent with the circumstances and applicable law.

 

33. Changes to These Terms

Throw Ann Arbor may revise these Terms from time to time.

 

The “Last Updated” date at the top of this page identifies the most recent version.

 

Changes generally apply prospectively.

The terms applicable to a completed purchase or booking will ordinarily be the terms in effect when the transaction was completed unless the customer subsequently agrees to different terms or applicable law requires otherwise.

 

If a material change requires renewed consent under applicable law, we will request that consent.

 

34. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

 

Subject to any legal right that cannot be altered by agreement, disputes arising out of these Terms or transactions with Throw Ann

Arbor may be brought in a court of competent jurisdiction serving Washtenaw County, Michigan.

 

Before filing a legal action, customers are encouraged to contact Throw Ann Arbor at support@throwannarbor.com so that we have an opportunity to attempt to resolve the issue informally.

 

35. Severability

If a provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed if necessary.

 

The remaining provisions will continue in effect.

 

36. No Waiver

A failure by Throw Ann Arbor to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision in the future.

 

37. Assignment

You may not assign rights under a membership, booking, or other personal service agreement without Throw Ann Arbor's permission.

Throw Ann Arbor may assign these Terms in connection with a merger, reorganization, sale of the business, or transfer of substantially all relevant business assets, subject to applicable law.

 

38. Entire Agreement and Order of Precedence

These Terms, together with any applicable:

• Participant Liability Waiver;

• Membership Agreement;

• Studio Rules;

• Privacy Policy;

• cancellation or refund policy;

• youth-program registration terms;

• event agreement; and

• service-specific terms disclosed at the time of purchase

constitute the agreement applicable to the relevant transaction.

 

If there is a conflict, a separately signed or expressly accepted agreement governing a specific service will generally control over these general Terms with respect to that service.
